PRODUCT, APP & SAFETY TERMS OF USE

These Products, App & Safety Terms of Use (“Terms”) are an agreement between Genesis Training Solutions LLC (“Genesis Training Solutions,” “GTS,” “we,” “us,” or “our”) and the individual or entity using a Genesis Training Solutions product, the Genesis Training Solutions mobile application (“GTS App”), or related services (“you” or “user”).

PLEASE READ THESE TERMS CAREFULLY.

By downloading, accessing, connecting to, controlling, purchasing, setting up, or using the GTS App or any Genesis Training Solutions product, including but not limited to reactive, moving, or electronically controlled shooting targets such as Pivot, you acknowledge that you have read, understood, and agree to these Terms.

If you do not agree to these Terms, do not use the GTS App or Genesis Training Solutions products.

1. ELIGIBILITY AND AUTHORITY

You must be at least 18 years old and legally capable of entering into this agreement to accept these Terms.

If a person under 18 uses a Genesis Training Solutions product or the GTS App, a parent or legal guardian must accept these Terms and is responsible for supervising that use.

If you use the GTS App or a GTS product on behalf of a business, range, organization, agency, or other entity, you represent that you have authority to accept these Terms on its behalf.

2. FIREARM AND RANGE SAFETY

Firearms and live-fire training involve inherent risks of serious bodily injury, death, and property damage.

Genesis Training Solutions products are training tools. They do not replace safe firearm handling, professional instruction, range rules, proper judgment, or compliance with applicable laws.

You agree that you are solely responsible for maintaining safe firearm handling practices at all times, including but not limited to:

• Treating every firearm as if it is loaded.

• Keeping firearms pointed in a safe direction.

• Keeping your finger off the trigger until you are ready to fire.

• Knowing your target and what is beyond it.

• Maintaining an appropriate and safe backstop.

• Following all applicable range rules.

• Using appropriate eye and hearing protection.

• Maintaining safe shooting distances appropriate for the target, ammunition, firearm, target material, and conditions.

• Inspecting equipment before use.

• Stopping use immediately if equipment appears damaged, unstable, improperly positioned, or unsafe.

The user is responsible for determining whether a particular firearm, ammunition type, shooting distance, target arrangement, training exercise, or range environment is appropriate and safe.

3. MOVING AND REACTIVE TARGET WARNING

Genesis Training Solutions products may move automatically, remotely, unexpectedly, or in response to sensors, timers, impacts, software commands, or other inputs.

Movement may occur differently than expected because of circumstances including, but not limited to:

• Bluetooth or wireless connectivity interruptions;

• delayed or duplicated commands;

• loss or restoration of connection;

• battery depletion or voltage changes;

• sensor activation or false activation;

• software or firmware errors;

• mechanical wear or failure;

• motor, electronic, or component failure;

• environmental conditions;

• user configuration;

• impact or damage; or

• other circumstances outside the control of Genesis Training Solutions.

You must maintain a safe environment assuming that a GTS target may move or fail to move at any time.

Never place any person or body part in a location where unexpected target movement could cause injury.

Disconnect power and make the equipment safe before performing maintenance, adjustment, inspection, repair, or clearing an obstruction.

4. THE GTS APP IS NOT A SAFETY SYSTEM

The GTS App, Bluetooth connection, sensors, timers, target position indicators, status indicators, battery information, movement commands, or any other electronic feature must never be relied upon to determine whether it is safe to discharge a firearm.

The GTS App and connected products may experience interruptions, delays, communication failures, incorrect status information, software errors, or unexpected behavior.

A displayed target position or app status does not guarantee the actual physical position or condition of the connected equipment.

Always visually confirm range conditions and target conditions before firing.

Never rely on the GTS App, a connected device, or any automated feature as a substitute for visual confirmation, firearm safety procedures, range commands, or human judgment.

5. ASSUMPTION OF RISK

You understand and voluntarily assume the risks associated with firearms training and the use of shooting targets, moving equipment, electronic equipment, wireless controls, sensors, motors, batteries, and related products.

These risks may include, without limitation:

• firearm-related injury or death;

• ricochet, fragmentation, or bullet splash;

• unexpected target movement;

• mechanical failure;

• electrical failure;

• equipment damage;

• property damage;

• misuse by another person;

• improper installation or setup;

• software or wireless communication failures; and

• other foreseeable or unforeseeable risks associated with live-fire training and moving target systems.

To the fullest extent permitted by applicable law, you voluntarily assume these risks when using Genesis Training Solutions products or services.

Nothing in these Terms is intended to waive any right or liability that cannot lawfully be waived.

6. PROPER USE

You agree to use Genesis Training Solutions products only:

• for their intended training purposes;

• in accordance with product instructions;

• in a lawful manner;

• in an appropriate training or shooting environment; and

• in a manner that does not create an unreasonable risk to yourself or others.

You may not use a GTS product or the GTS App for any illegal or unauthorized purpose.

You are responsible for complying with all applicable local, state, federal, and other laws and regulations relating to firearms, shooting ranges, possession, transportation, target systems, wireless devices, and your particular use of the product.

7. INSPECTION, MAINTENANCE, AND MODIFICATION

You are responsible for inspecting GTS equipment before use.

Do not use equipment that is damaged, excessively worn, improperly assembled, unstable, or functioning abnormally.

Unauthorized alterations, modifications, repairs, substitutions, or defeat of safety-related design features may create unpredictable behavior and may void applicable warranty coverage.

Follow the maintenance, inspection, repair, and replacement recommendations provided by Genesis Training Solutions.

8. LICENSE TO USE THE GTS APP

Subject to these Terms, Genesis Training Solutions grants you a limited, revocable, non-exclusive, non-transferable license to download and use the GTS App on devices that you own or control for its intended purpose.

The GTS App is licensed, not sold.

Except where applicable law expressly permits otherwise, you may not:

• copy or redistribute the GTS App;

• reverse engineer, decompile, or disassemble it;

• attempt to derive its source code;

• modify or create derivative works from it;

• bypass security or access controls;

• use the GTS App to interfere with another device, network, or system; or

• use the GTS App in a manner inconsistent with these Terms.

9. APP, BLUETOOTH, SOFTWARE, AND SERVICE AVAILABILITY

We do not guarantee that the GTS App, wireless communication, Bluetooth connection, firmware, sensors, servers, or other electronic services will operate without interruption, delay, error, or failure.

Features may be changed, updated, suspended, or discontinued.

Updates to the GTS App or product firmware may be necessary to maintain functionality, compatibility, security, or performance.

You are responsible for maintaining compatible hardware, software, operating systems, connectivity, and power sources.

The GTS App and related electronic services are not designed or intended to function as emergency, life-safety, firearm-safety, or fail-safe systems.

10. WARRANTIES

Physical Genesis Training Solutions products may be covered by a separate written Limited Warranty. Any applicable written warranty is governed by its own terms.

Except for warranties expressly provided by Genesis Training Solutions in writing and except where prohibited by law, the GTS App and related services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not warrant that the GTS App or connected products will always operate uninterrupted, error-free, or exactly as anticipated in every environment or configuration.

Nothing in these Terms eliminates any warranty, consumer protection right, or remedy that cannot lawfully be excluded.

11. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GENESIS TRAINING SOLUTIONS LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATED TO THE USE OR INABILITY TO USE THE GTS APP, WEBSITE, PRODUCTS, OR SERVICES.

THE USER IS RESPONSIBLE FOR THE SAFE SETUP, HANDLING, OPERATION, STORAGE, MAINTENANCE, AND USE OF GTS PRODUCTS.

GENESIS TRAINING SOLUTIONS SHALL NOT BE RESPONSIBLE FOR DAMAGES, INJURIES, LOSSES, OR LEGAL CONSEQUENCES RESULTING FROM UNLAWFUL USE, UNSAFE USE, IMPROPER INSTALLATION, FAILURE TO FOLLOW INSTRUCTIONS, UNAUTHORIZED MODIFICATION, FAILURE TO FOLLOW FIREARM SAFETY PRACTICES, OR USE OF A PRODUCT OUTSIDE ITS INTENDED PURPOSE.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

12. USER RESPONSIBILITY AND INDEMNIFICATION

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Genesis Training Solutions LLC and its members, officers, employees, contractors, agents, and affiliates from third-party claims, liabilities, losses, damages, and reasonable costs arising from:

• your unlawful or improper use of a GTS product or the GTS App;

• your violation of these Terms;

• your violation of applicable law;

• your unauthorized modification of a GTS product;

• your violation of another person's rights; or

• your negligent or intentional acts or omissions.

This provision does not require you to indemnify Genesis Training Solutions for liability that applicable law does not permit to be transferred or waived.

13. INTELLECTUAL PROPERTY

The GTS App, software, firmware, product designs, graphics, logos, text, photographs, videos, documentation, trademarks, and other content provided by Genesis Training Solutions are owned by Genesis Training Solutions or its licensors and are protected by applicable intellectual property laws.

No ownership rights are transferred to you by downloading or using the GTS App or purchasing a GTS product.

You may not copy, reproduce, distribute, modify, or commercially exploit protected Genesis Training Solutions materials except with prior written authorization or as otherwise permitted by law.

14. PRIVACY

Your use of the GTS App is also subject to our Privacy Policy.

The Privacy Policy explains what information we collect, how it is used, how it may be disclosed or shared, how long it may be retained, and the choices available to users.

Where required, the GTS App will request permission before accessing information or device features requiring user consent.

15. THIRD-PARTY SERVICES

The GTS App may rely upon or interact with operating systems, app stores, Bluetooth services, mobile devices, or services supplied by third parties.

Genesis Training Solutions does not control those third-party products or services and is not responsible for their availability, performance, policies, or practices.

You agree to comply with applicable third-party terms when using the GTS App.

16. CHANGES TO THESE TERMS

We may modify these Terms from time to time.

If we make a material change affecting use of the GTS App or GTS products, we may require you to review and accept the updated Terms before continuing to use certain features.

The effective date appearing at the beginning of these Terms identifies the applicable version.

17. TERMINATION

We may suspend or terminate access to the GTS App or related services if you materially violate these Terms, misuse the service, interfere with its operation, or engage in unlawful activity involving the service.

You may stop using the GTS App at any time.

Sections that by their nature should survive termination, including provisions concerning intellectual property, assumption of risk, limitations of liability, and indemnification, will survive termination to the extent permitted by law.

18. APPLE-SPECIFIC TERMS

The following provisions apply when the GTS App is obtained through Apple's App Store.

Acknowledgment

These Terms are between you and Genesis Training Solutions LLC, not Apple Inc. Genesis Training Solutions, and not Apple, is responsible for the GTS App and its content.

Scope of License

Your license to use the GTS App is non-transferable and permits you to use the GTS App on Apple-branded products that you own or control and as permitted by the applicable Apple Media Services usage rules, including applicable Family Sharing or volume-purchasing rights.

Maintenance and Support

Genesis Training Solutions is responsible for maintenance and support of the GTS App as required under these Terms or applicable law.

Apple has no obligation to provide maintenance or support for the GTS App.

Warranty

Genesis Training Solutions is responsible for any warranties applicable to the GTS App to the extent those warranties have not lawfully been disclaimed.

If the GTS App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund any purchase price paid to Apple for the GTS App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation regarding the GTS App.

Product Claims

Genesis Training Solutions, and not Apple, is responsible for addressing claims by you or third parties relating to the GTS App or your possession or use of the GTS App, including product-liability claims, claims concerning legal or regulatory requirements, and claims arising under consumer-protection or privacy laws.

Intellectual Property Claims

If a third party claims that the GTS App or your possession or use of the GTS App infringes that party's intellectual-property rights, Genesis Training Solutions, and not Apple, is responsible for the investigation, defense, settlement, and resolution of that claim.

Legal Compliance

You represent that you are not located in a country or region subject to a United States government embargo or designated by the United States government as supporting terrorism and that you are not listed on any United States government prohibited or restricted-party list.

Third-Party Terms

You must comply with applicable third-party agreements when using the GTS App, including terms applicable to your mobile device, wireless service, operating system, and App Store account.

Apple as Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms as they relate to the iOS version of the GTS App.

Upon your acceptance of these Terms, Apple will have the right to enforce applicable provisions of these Terms against you as a third-party beneficiary.

19. ELECTRONIC ACCEPTANCE

By selecting a checkbox stating that you have read and agree to these Terms and selecting “Agree & Continue,” “Accept,” or similar language, you are providing your electronic acceptance of these Terms.

We may maintain a record of the version of the Terms you accepted and the date of acceptance.

20. GOVERNING LAW AND SEVERABILITY

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except where applicable law requires otherwise.

If any provision of these Terms is determined to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
